Americans with Disabilities Act (ADA) Service & Coordinator
Complaints that a program, service, or activity of the City of Edina is not accessible to persons with disabilities should be directed to the ADA Coordinator. The City of Edina is committed to make all City programs, services and activities accessible to everyone. Most complaints can be resolved without resorting to lengthy and costly procedures. If however, you reach at a point where it is necessary to file a formal complaint, please fill out a Grievance Form online or download a printable Grievance Form (PDF) and return it to the ADA Coordinator. The City's Grievance Procedure is as follows.
City of Edina Grievance Procedure Under The Americans with Disabilities Act
This Grievance Procedure is established to meet the requirements of Title II of the Americans with Disabilities Act of 1990 ("ADA"). It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the City of Edina (the "City"). The City's Harassment Prevention and Respectful Workplace Policy, located in the Employee Handbook, governs employment-related complaints of disability discrimination.
An individual may file a grievance in writing. A written grievance should be filed on the ADA Grievance Form. If it is not filed on the Grievance Form, it should be in writing and contain all of the following information:
- The name, address, and telephone number of the person filing the grievance.
- The name, address, and telephone number of the person alleging the ADA violation, if other than the person filing the grievance.
- A description of the alleged violation and the remedy sought.
- Information on whether a complaint has been filed with the Department of Justice or other federal or state civil rights agency or court.
- If a complaint has been filed, the name of the agency or court where the complaint was filed, the date the complaint was filed, and the name, address and telephone number of a contact person with the agency with which the complaint was filed.

Within 15 calendar days after receipt of the complaint, the ADA Coordinator or his/her designee will discuss with the complainant the complaint and the possible resolutions. Within 30 calendar days of the receipt, the ADA Coordinator will conduct the investigation necessary to determine the validity of the alleged violation. If appropriate, the ADA Coordinator will arrange to meet with the complainant to discuss the matter and attempt to reach an informal resolution to the complaint. Any informal resolution of the complaint will be documented in the City's ADA Grievance File.
If an informal resolution of the complaint is not reached, the ADA Coordinator shall issue a written determination of the validity of the complaint. This determination will explain the position of the City and offer options for substantive resolution of the complaint no later than 60 calendar days from the date of the City's receipt of the complaint. A copy will be forwarded to the complainant. Where appropriate, this response will be in a format accessible to the complainant, such as large print, Braille, or audio tape. The response will.
The complainant may request reconsideration if he/she is dissatisfied with the written determinations. The request for reconsideration shall be in writing and filed with the Assistant City Manager:

...within 15 calendar days after the ADA Coordinator's determination has been mailed to the complainant. The Assistant City Manager shall review the request for reconsideration and make a final determination within 60 days from the filing of the request. If the complainant is dissatisfied with City's handling of the complaint at any point, the complainant may file a complaint directly with the U.S. Department of Justice or other appropriate state or federal agency. Use of the City's grievance procedure is not a prerequisite to the pursuit of other remedies.
Because of the varying circumstances in any specific grievance, the City's resolution of a grievance does not create precedent that binds the City or upon which other complaining parties may rely.
Any written complaints received by the ADA Coordinator or his/her designee, appeals to the Assistant City Manager, and responses from these two offices will be retained by Edina for at least three years.
